Service Agreement

By listing one's property on For Sale By Owner New Mexico.com (hereinafter "FSBONM.com"), Seller agrees to the following terms and conditions:
- FSBONM.com represents neither the buyer nor the seller. FSBONM.com simply provides an advertising forum for its sellers. The duration of this service is 90 days. This service duration may be extended for $1 per month from the expiration of the 90 day period mentioned above until the closing date for the sale of the property or until the listing Seller decides to take the property off the market or list the property with a real estate agent or broker.
- The original service fee is non-refundable and non-transferable.
- The home Seller is exclusively responsible for the accuracy of their listing. Furthermore, seller agrees to indemnify, defend, and hold harmless FSBO.com for any actual or alleged damages resulting from claims related to the accuracy of the listing or information provided therein.
- This service is for one property only and may not be transferred to another property without the written approval of FSBONM.com. As part of this service the Seller will receive a sign to display in front of their home. Seller agrees that Seller is renting this sign and that FSBONM.com owns the sign. A Fifty Dollar ($50) fee for the sign will be charged if the sign is not returned to FSBONM.com in an acceptable condition.
- Seller is responsible for any damage to the sign beyond normal wear and tear. Nothing may be attached to the FSBONM.com –supplied yard sign, other than placards or information tubes supplied by FSBONM.com.
- The signs described in the preceding paragraphs will be delivered only to properties in our delivery area. Signs may be picked up from FSBONM.com for use outside the normal delivery area. Please see our service area to determine if your location is in our delivery area.
- Seller agrees to locate and verify a safe location for the sign and agrees that FSBONM.com is not responsible for any damage to underground utilities, sprinkler pipes, or any other objects that could be damaged by the installation of the sign. Signs are secured with a 10" spike driven into the ground.
- Seller agrees not to list their property on FSBONM.com while the same property is listed with a real estate agency or broker, with the sole exception of properties that are listed on the Southwest Multiple Listing Service through the affiliated listing service, Fixed Fee Realty. Seller agrees that listing their property on FSBONM.com is an exclusive arrangement and further agrees that the same property shall not be listed on any other For Sale By Owner website or service while the same property is listed with FSBONM.com.
- Seller agrees that any buyer's agent or broker shall not be allowed to place their Realtor® yard sign on or near the property at any time while the property is listed with FSBONM.com.
- Seller agrees to place a "Sale Pending" placard (which will be provided to Seller by FSBONM.com), on the FSBONM.com yard sign upon execution of a purchase agreement, allowing the "Sale Pending" placard to remain on the yard sign either until the closing or until such time that a sale is no longer pending.
